*Limited Warranty*

Should an issue arise with your Ostrich product, please first contact the retailer where your product was purchased, as the product may fall under their return policy. If that process does not resolve the issue, proceed to the steps below.

Deltess Corp. (“Deltess”) is the warrantor for Ostrich products. Please read through this limited warranty statement carefully.

Ostrich products have been designed and manufactured in order to provide maximum satisfaction and safety and are solely intended for personal or leisure use in accordance with the weight restrictions for which it is rated. Deltess warrants to the original end user purchaser that (i) its Ostrich chairs will be free from manufacturing defects for 90 days from the date of purchase or delivery (if later than the date of purchase), and (ii) its Ostrich PakSeats will be free from manufacturing defects for 1 year from the date of purchase or delivery (if later than the date of purchase).

Because Deltess cannot control the quality of products sold by unauthorized sellers, this warranty applies only to Ostrich products that were purchased from Deltess or a Deltess authorized seller in the United States, unless otherwise prohibited by law. Deltess reserves the right to reject warranty claims for Ostrich products purchased from unauthorized sellers, including unauthorized Internet sites.

This warranty does not cover:

• damage for use of the product in excess of the weight requirements (including, but not limited to, use of the product by more than one person at the same time, even if for a short period or partially leaning on it);
• damage due to commercial use;
• damage due to improper assembly or care;
• abuse or misuse (including leaving the product outside when not in use);
• normal wear and tear (including the natural breakdown of colors and material over time);
• rips and burns;
• rust; and
• mold

Note: Ostrich uses steel in a variety of applications and forms for its outdoor furniture because of its durability. Although furniture frames are cleaned, primed, and coated for protection, steel components can rust and are not covered under warranty.

Purchasers of an Ostrich product who wish to make a warranty claim based upon an alleged product defect should contact us through ostrichchairs.com, email us at info@deltess.com, or call us at 609-564-0413. Please have the following information available: (1) description of alleged defect, (2) photographs depicting the alleged defect, (3) proof of purchase, and (4) if purchased from Deltess directly, your order number.

Subject to the shipping costs below, Deltess will replace the product or send a replacement part for products or parts covered by this warranty.

If you purchased your Ostrich product directly from Deltess at ostrichchairs.com, you will receive free shipping on your replacement product or part. Have your original order number handy to ensure this benefit.

If you purchased your Ostrich product from another retailer, your replacement part is free and the shipping charge is free.

If you purchased your Ostrich product from another retailer and your product is being replaced under this warranty, your replacement product is free but you will be responsible for the shipping charge. The shipping charge varies based upon the product subject to the warranty claim. Contact info@deltess.com or call us at 609-564-0413 to understand what the shipping cost will be.

Note: This warranty is not a return policy. Undamaged products purchased from a Deltess retailer or dealer must be returned to the retailer or dealer from which it was purchased under the dealer or retailer’s return policy. There are no warranties which extend beyond those stated herein. ANY IMPLIED WARRANTIES THAT MAY BE APPLICABLE TO PRODUCTS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

UNDER NO CIRCUMSTANCES SHALL DELTESS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF THIS LIMITED WARRANTY, BREACH OF CONTRACT OR STRICT LIABILITY. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
